These Terms of Service ("Terms") govern your access to and use of GetSleepyFlow (the "Service"), operated by Perez Media Agency ("we", "us"). By using the Service, you agree to these Terms.
1. User Accounts & Subscription Management
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Premium subscriptions are billed in advance and auto-renew until cancelled. You may cancel at any time from your account dashboard to stop future renewals; cancellation does not retroactively refund completed billing periods (see Refund Policy).
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Reverse engineer, scrape, or attempt to access non-public parts of the Service.
- Interfere with or disrupt the integrity, security, or performance of the Service.
- Use the Service to provide medical advice or as a substitute for professional medical care.
GetSleepyFlow is a wellness tool, not a medical device. Always consult a qualified healthcare provider for any sleep-related medical condition.
3. Intellectual Property
All content, branding, design, code, and trademarks on the Service are owned by Perez Media Agency or its licensors and are protected by U.S. and international intellectual property laws. You receive a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.
4. Third-Party Services
The Service integrates with third-party providers (Stripe, Google, Oura, Apple, Brevo, n8n). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the maximum extent permitted by law, Perez Media Agency and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
7. Termination
We may suspend or terminate your access to the Service at any time for breach of these Terms. You may stop using the Service at any time.
8. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, where Perez Media Agency is headquartered (Munich, Germany), without regard to conflict-of-laws principles. Exclusive jurisdiction lies with the courts of Munich, Germany, to the extent permitted by applicable consumer-protection law in your country of residence.
9. Changes
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
